Federal Appeals Court Returns Prempro Case to State Court

A case has been returned to a state court on behalf of a federal Appeals Court that includes over 100 cases filed against the makers of hormone replacement therapy drugs that many women allege, caused the growth of breast cancer. The U.S. Court of Appeals for the Eighth Circuit reversed a lower court ruling in the Eastern District of Arkansas that dismissed many of the cases and blocked most of the lawsuits from being sent back to state court in Minnesota. Doctors prescribed the hormone replacement drug to women who struggled with menopause. A study conducted in 2002 proved that women who were taking the drug were at a greater risk of developing breast cancer than women who were not using the hormone replacements. The Appeals Court found that the district court didn’t have jurisdiction and the lower court rulings were reversed.
